.elementor-drop-cap-letter{display:inline-block}<\/style>\t\t\t\t<p>O\u00a0<strong>Decreto\u2011Lei n.\u00ba 108\/2026, de 29 de maio<\/strong>, procede \u00e0 21.\u00aa altera\u00e7\u00e3o ao\u00a0<strong>RJUE<\/strong>\u00a0(Decreto\u2011Lei n.\u00ba 555\/99) e ajusta a reforma de licenciamentos do\u00a0<strong>Decreto\u2011Lei n.\u00ba 10\/2024<\/strong>, no quadro do SIMPLEX. O objetivo declarado \u00e9 corrigir dificuldades de aplica\u00e7\u00e3o pr\u00e1tica, refor\u00e7ando a simplifica\u00e7\u00e3o sem sacrificar seguran\u00e7a jur\u00eddica nem a prote\u00e7\u00e3o dos interesses p\u00fablicos e privados, em particular no contexto da pol\u00edtica de habita\u00e7\u00e3o.<\/p><p>O diploma republica integralmente o RJUE e assenta na autoriza\u00e7\u00e3o legislativa conferida pela Lei n.\u00ba 9\u2011B\/2026, que j\u00e1 antecipava a revis\u00e3o do regime de licenciamento urban\u00edstico e da reabilita\u00e7\u00e3o urbana.<\/p><p><strong>1. Comunica\u00e7\u00e3o pr\u00e9via como regra nas \u00e1reas com par\u00e2metros definidos<\/strong><\/p><p>O Governo assume que a\u00a0<strong>comunica\u00e7\u00e3o pr\u00e9via<\/strong>\u00a0j\u00e1 n\u00e3o funcionava como verdadeiro controlo pr\u00e9vio e passa a trat\u00e1\u2011la como mecanismo assente na\u00a0<strong>assun\u00e7\u00e3o de responsabilidade do interessado<\/strong>, com controlo sucessivo pelos munic\u00edpios.<\/p><p>Assim, nas \u00e1reas em que os\u00a0<strong>par\u00e2metros urban\u00edsticos estejam efetivamente definidos<\/strong>\u00a0(planos de pormenor, unidades de execu\u00e7\u00e3o, opera\u00e7\u00f5es de loteamento), a regra passa a ser a comunica\u00e7\u00e3o pr\u00e9via para loteamentos, obras de urbaniza\u00e7\u00e3o e obras de constru\u00e7\u00e3o\/altera\u00e7\u00e3o\/amplia\u00e7\u00e3o, reservando o licenciamento para situa\u00e7\u00f5es \u201crestantes\u201d ou sens\u00edveis (patrim\u00f3nio, servid\u00f5es, etc.).<\/p><p>Mant\u00e9m\u2011se um\u00a0controlo sucessivo\u00a0municipal, com prazo de um ano para aprecia\u00e7\u00e3o da conformidade legal e regulamentar dos elementos instrut\u00f3rios da comunica\u00e7\u00e3o pr\u00e9via (sem preju\u00edzo da fiscaliza\u00e7\u00e3o a todo o tempo).<\/p><p><strong>2. Procedimentos e prazos: saneamento, deferimento t\u00e1cito e audi\u00eancia pr\u00e9via<\/strong><\/p><p>O novo regime refor\u00e7a a fase de\u00a0<strong>saneamento e aprecia\u00e7\u00e3o liminar<\/strong>: o presidente da c\u00e2mara disp\u00f5e de 20 dias para decidir sobre aperfei\u00e7oamentos, rejei\u00e7\u00f5es liminares, extin\u00e7\u00e3o do procedimento (se o tipo de controlo for outro) ou prorroga\u00e7\u00e3o dos prazos de decis\u00e3o nos casos complexos. Findo esse prazo, considera\u2011se o pedido corretamente instru\u00eddo.<\/p><p>S\u00e3o fixados <strong>prazos m\u00e1ximos claros<\/strong> para:<\/p><ul><li>Informa\u00e7\u00e3o pr\u00e9via (15 ou 45\/30 dias, consoante o tipo de pedido), com possibilidade de <strong>deferimento t\u00e1cito<\/strong>.<\/li><li>Aprecia\u00e7\u00e3o do projeto de arquitetura (30 dias, prorrog\u00e1vel uma vez em casos complexos).<\/li><li>Decis\u00e3o sobre o licenciamento (20 dias para certas obras de edifica\u00e7\u00e3o, 30 dias para urbaniza\u00e7\u00e3o\/remodela\u00e7\u00e3o, 45 dias para loteamento), sob pena de <strong>deferimento t\u00e1cito<\/strong>.<\/li><\/ul><p>A audi\u00eancia pr\u00e9via \u00e9 racionalizada: admite\u2011se apenas uma entrega de altera\u00e7\u00f5es ao projeto, e apenas quando visem corrigir desconformidades detetadas; no licenciamento de determinadas obras n\u00e3o \u00e9 admitida altera\u00e7\u00e3o de projeto em audi\u00eancia, apenas jun\u00e7\u00e3o de elementos em falta.<\/p><p><strong>3. Clarifica\u00e7\u00e3o de conceitos e amplia\u00e7\u00e3o de isen\u00e7\u00f5es<\/strong><\/p><p>S\u00e3o clarificados conceitos estruturantes:<\/p><ul><li><strong>Edifica\u00e7\u00e3o<\/strong> passa a abranger qualquer constru\u00e7\u00e3o incorporada no territ\u00f3rio com car\u00e1ter de perman\u00eancia, independentemente do sistema construtivo.<\/li><li>As <strong>obras de reconstru\u00e7\u00e3o<\/strong>\u00a0s\u00e3o redefinidas como reconstitui\u00e7\u00e3o do \u201c\u00faltimo antecedente v\u00e1lido\u201d, com manuten\u00e7\u00e3o da composi\u00e7\u00e3o formal de todas as fachadas e cobertura, permitindo apenas corre\u00e7\u00f5es construtivas necess\u00e1rias \u00e0 seguran\u00e7a e salubridade.<\/li><li>As <strong>obras de amplia\u00e7\u00e3o<\/strong> passam a abranger expressamente qualquer aumento de \u00e1rea, altura ou volume.<\/li><\/ul><p>Com base nesta clarifica\u00e7\u00e3o, as\u00a0<strong>obras de reconstru\u00e7\u00e3o<\/strong>\u00a0passam a estar\u00a0<strong>isentas de licen\u00e7a e comunica\u00e7\u00e3o pr\u00e9via<\/strong>, por corresponderem a uma mera reposi\u00e7\u00e3o da situa\u00e7\u00e3o anterior \u2013 regra que se estende a im\u00f3veis em zonas de prote\u00e7\u00e3o de im\u00f3veis classificados, salvaguardando pareceres espec\u00edficos quando exigidos por legisla\u00e7\u00e3o de patrim\u00f3nio.<\/p><p>\u00c9 ainda classificada como <strong>obra de escassa relev\u00e2ncia urban\u00edstica<\/strong> a substitui\u00e7\u00e3o de caixilharias por outras energeticamente mais eficientes, desde que se mantenham geometria e acabamento exterior id\u00eanticos, incluindo em zonas de prote\u00e7\u00e3o de im\u00f3veis classificados.<\/p><p><strong>4. T\u00edtulos urban\u00edsticos e impacto nas transa\u00e7\u00f5es imobili\u00e1rias<\/strong><\/p><p>\u00c9 criado um regime detalhado de\u00a0<strong>\u201ct\u00edtulos urban\u00edsticos\u201d<\/strong>\u00a0(licen\u00e7a, comunica\u00e7\u00e3o pr\u00e9via e comunica\u00e7\u00e3o pr\u00e9via com prazo), assente em modelos normalizados aprovados por portaria:<\/p><ul><li>A licen\u00e7a \u00e9 titulada pelo requerimento\u2011modelo (com s\u00edntese da opera\u00e7\u00e3o), comprovativo de pagamento de taxas\/encargos e notifica\u00e7\u00e3o de deferimento ou comprovativo de submiss\u00e3o em caso de deferimento t\u00e1cito.<\/li><li>A comunica\u00e7\u00e3o pr\u00e9via e a comunica\u00e7\u00e3o pr\u00e9via com prazo s\u00e3o tituladas pelo respetivo modelo e comprovativo de pagamento das taxas\/encargos.<\/li><\/ul><p>Nas\u00a0<strong>transmiss\u00f5es de pr\u00e9dios urbanos<\/strong>\u00a0(terreno para constru\u00e7\u00e3o, edif\u00edcios constru\u00eddos ou em constru\u00e7\u00e3o, fra\u00e7\u00f5es), passa a ser obrigat\u00f3rio que o conservador, not\u00e1rio, advogado ou solicitador refiram no t\u00edtulo:<\/p><ol><li>exist\u00eancia do t\u00edtulo urban\u00edstico;<\/li><li>declara\u00e7\u00e3o do transmitente de que disp\u00f5e de t\u00edtulo; ou<\/li><li>declara\u00e7\u00e3o de que n\u00e3o disp\u00f5e de t\u00edtulo, <strong>sob pena de anulabilidade do neg\u00f3cio<\/strong>.<\/li><\/ol><p><strong>5. Utiliza\u00e7\u00e3o e altera\u00e7\u00e3o de uso: fim da \u201clicen\u00e7a de utiliza\u00e7\u00e3o\u201d cl\u00e1ssica<\/strong><\/p><p>\u00c9 repristinado e reformulado o artigo 62.\u00ba do RJUE, clarificando que a\u00a0<strong>utiliza\u00e7\u00e3o de edif\u00edcios ou fra\u00e7\u00f5es na sequ\u00eancia de obras s\u00f3 pode ocorrer ap\u00f3s conclus\u00e3o das mesmas e verifica\u00e7\u00e3o da conformidade<\/strong>\u00a0com projetos aprovados\/comunicados e normas de usos admiss\u00edveis.<\/p><p>A antiga \u201clicen\u00e7a de utiliza\u00e7\u00e3o\u201d \u00e9 substitu\u00edda por dois mecanismos:<\/p><ul><li><strong>Comunica\u00e7\u00e3o pr\u00e9via de utiliza\u00e7\u00e3o\/altera\u00e7\u00e3o de uso<\/strong> (art. 62.\u00ba\u2011A), quando a utiliza\u00e7\u00e3o \u00e9 precedida de obra sujeita a licen\u00e7a\/comunica\u00e7\u00e3o ou isenta com base em informa\u00e7\u00e3o pr\u00e9via favor\u00e1vel. Neste caso, a utiliza\u00e7\u00e3o pode iniciar\u2011se imediatamente ap\u00f3s submiss\u00e3o dos elementos exigidos, ficando sujeita a controlo sucessivo.<\/li><li><strong>Comunica\u00e7\u00e3o pr\u00e9via com prazo<\/strong> (art. 62.\u00ba\u2011B), quando a utiliza\u00e7\u00e3o\/altera\u00e7\u00e3o de uso n\u00e3o foi precedida de obra titulada. O edif\u00edcio ou fra\u00e7\u00e3o pode ser utilizado ap\u00f3s 10 dias, salvo despacho de rejei\u00e7\u00e3o ou determina\u00e7\u00e3o de vistoria.<\/li><\/ul><p>Estas comunica\u00e7\u00f5es podem implicar\u00a0<strong>ced\u00eancias e outros encargos<\/strong> se, pela sua natureza, forem qualificadas em regulamento municipal como opera\u00e7\u00f5es de impacte relevante ou semelhante a loteamento.<\/p><p><strong>6. Ced\u00eancias, habita\u00e7\u00e3o p\u00fablica e arrendamento acess\u00edvel<\/strong><\/p><p>O regime de <strong>ced\u00eancia de \u00e1reas e compensa\u00e7\u00f5es<\/strong> \u00e9 ajustado, em particular quando est\u00e1 em causa <strong>habita\u00e7\u00e3o p\u00fablica, habita\u00e7\u00e3o de custos controlados ou arrendamento acess\u00edvel<\/strong>:<\/p><ul><li>As parcelas a ceder para habita\u00e7\u00e3o p\u00fablica, custos controlados ou arrendamento acess\u00edvel integram o dom\u00ednio <strong>privado<\/strong> do munic\u00edpio, podendo este definir requisitos de admissibilidade em regulamento municipal.<\/li><li>Se o promotor afetar diretamente lotes ou parcelas \u00e0 constru\u00e7\u00e3o de habita\u00e7\u00e3o de custos controlados ou para arrendamento acess\u00edvel, essas \u00e1reas contam para o cumprimento dos par\u00e2metros de dimensionamento, <strong>sem gerar ced\u00eancia ou compensa\u00e7\u00e3o adicional<\/strong>.<\/li><\/ul><p>O\u00a0<strong>RJRU<\/strong> (Decreto\u2011Lei n.\u00ba 307\/2009) \u00e9 alinhado com este modelo, permitindo que regulamentos municipais definam regimes especiais de c\u00e1lculo de compensa\u00e7\u00f5es pela n\u00e3o ced\u00eancia de \u00e1reas para habita\u00e7\u00e3o p\u00fablica\/custos controlados\/arrendamento acess\u00edvel.<\/p><p><strong>7. Nulidades, caducidades e contraordena\u00e7\u00f5es<\/strong><\/p><p>O regime de\u00a0<strong>nulidade das licen\u00e7as e decis\u00f5es de informa\u00e7\u00e3o pr\u00e9via<\/strong>\u00a0\u00e9 concentrado e associado a um prazo de\u00a0<strong>3 anos<\/strong>\u00a0para:<\/p><ul><li>O \u00f3rg\u00e3o administrativo declarar a nulidade;<\/li><li>O Minist\u00e9rio P\u00fablico, bem como a a\u00e7\u00e3o popular, intentarem a\u00e7\u00e3o de declara\u00e7\u00e3o de nulidade;<\/li><\/ul><p>salvaguardando os casos em que os factos constituam crime (prazo alargado \u00e0 prescri\u00e7\u00e3o penal) e exce\u00e7\u00f5es para monumentos nacionais.<\/p><p>No plano contraordenacional:<\/p><ul><li>\u00c9 reintroduzida (ajustada) a contraordena\u00e7\u00e3o pela <strong>realiza\u00e7\u00e3o de opera\u00e7\u00f5es urban\u00edsticas sem t\u00edtulo<\/strong> (licen\u00e7a\/comunica\u00e7\u00e3o\/informa\u00e7\u00e3o pr\u00e9via com os efeitos do art. 17.\u00ba, n.\u00ba 2), bem como pela falta de informa\u00e7\u00e3o pr\u00e9via sobre in\u00edcio de trabalhos e falta de envio de comprovativo de pagamento de taxas.<\/li><li>\u00c9 criado o artigo 99.\u00ba\u2011A, que sistematiza o <strong>regime das contraordena\u00e7\u00f5es urban\u00edsticas<\/strong>, remetendo subsidiariamente para o regime geral.<\/li><li>As falsas declara\u00e7\u00f5es dos t\u00e9cnicos em termos de responsabilidade ou livro de obra passam a ser expressamente qualificadas como <strong>crime de falsifica\u00e7\u00e3o de documentos<\/strong>, remetendo para o artigo 256.\u00ba do C\u00f3digo Penal.<\/li><li>O artigo 100.\u00ba\u2011A refor\u00e7a a <strong>responsabilidade solid\u00e1ria<\/strong> de promotores, donos da obra, empreiteiros, diretores de obra e fiscaliza\u00e7\u00e3o quando as opera\u00e7\u00f5es s\u00e3o realizadas sem t\u00edtulo ou em desconformidade com o mesmo.<\/li><\/ul><p><strong>8. Digitaliza\u00e7\u00e3o e SILUC<\/strong><\/p><p>A tramita\u00e7\u00e3o dos procedimentos passa a ser\u00a0<strong>obrigatoriamente desmaterializada<\/strong>, atrav\u00e9s de\u00a0<strong>plataforma eletr\u00f3nica de licenciamentos urban\u00edsticos<\/strong>, com interoperabilidade com sistemas municipais, proibindo\u2011se a cria\u00e7\u00e3o de fases ou formalidades adicionais pelos regulamentos locais.<\/p><p>At\u00e9 \u00e0 futura codifica\u00e7\u00e3o das normas t\u00e9cnicas de constru\u00e7\u00e3o, \u00e9 assumido o\u00a0<strong>SILUC \u2013 Sistema de Informa\u00e7\u00e3o sobre Legisla\u00e7\u00e3o do Urbanismo e da Constru\u00e7\u00e3o<\/strong> como base oficial para publicita\u00e7\u00e3o das disposi\u00e7\u00f5es legais e regulamentares a observar pelos t\u00e9cnicos.<\/p><p><strong>9. Aplica\u00e7\u00e3o no tempo<\/strong><\/p><p>O decreto\u2011lei aplica\u2011se:<\/p><ul><li>Aos procedimentos iniciados <strong>ap\u00f3s a sua entrada em vigor<\/strong>;<\/li><li>E tamb\u00e9m aos procedimentos j\u00e1 em curso que ainda se encontrem na fase de saneamento e aprecia\u00e7\u00e3o liminar, permitindo aos interessados adaptar a iniciativa ao novo regime.<\/li><\/ul><p>Entra em vigor no <strong>primeiro dia \u00fatil do terceiro m\u00eas seguinte ao da publica\u00e7\u00e3o<\/strong>, ou seja, no in\u00edcio de <strong>agosto de 2026<\/strong>, mantendo\u2011se em vigor, at\u00e9 l\u00e1, o regime atual com as altera\u00e7\u00f5es de 2024.<\/p><p><strong>10.
