altera\u00e7\u00f5es ao Regulamento Municipal do Alojamento Local de Lisboa (RMAL) que est\u00e3o em vigor desde 6 de dezembro de 2025? As altera\u00e7\u00f5es, promovidas pelo Aviso n.\u00ba 29926-A\/2025\/2, de 5 de dezembro, representam importante reforma para o setor. Apresentamos abaixo as principais mudan\u00e7as a ter em conta:<\/p><p><strong>1. \u00c1reas de Conten\u00e7\u00e3o na cidade de Lisboa<\/strong><\/p><p>A altera\u00e7\u00e3o ao RMAL implementou um sistema de monitoriza\u00e7\u00e3o mensal que opera em tr\u00eas escalas sobrepostas: concelho, freguesia e bairro.<\/p><p>Conten\u00e7\u00e3o Absoluta (R\u00e1cio \u2265 10%): nestas zonas, o bloqueio a novos registos \u00e9 quase total. Nestas \u00e1reas, a prioridade municipal \u00e9 a salvaguarda do uso habitacional, impedindo qualquer incremento da oferta de AL.<\/p><p>Conten\u00e7\u00e3o Relativa (R\u00e1cio entre 5% e 10%): nestas zonas a regra \u00e9 a interdi\u00e7\u00e3o, mas admite-se a concess\u00e3o de novos t\u00edtulos em situa\u00e7\u00f5es de exce\u00e7\u00e3o estrita. Estas exce\u00e7\u00f5es est\u00e3o geralmente vinculadas a opera\u00e7\u00f5es de reabilita\u00e7\u00e3o urbana de edif\u00edcios em estado de conserva\u00e7\u00e3o &#8220;P\u00e9ssimo&#8221; ou &#8220;Mau&#8221;, ou \u00e0 modalidade de &#8220;quartos&#8221; na resid\u00eancia permanente do titular.<\/p><p><strong>2. Novos registos de AL em \u00e1reas de conten\u00e7\u00e3o<\/strong><\/p><p>Para a atribui\u00e7\u00e3o de novos registos de AL, o RMAL distingue consoante a \u00e1rea seja de conten\u00e7\u00e3o absoluta ou relativa:<\/p><p style=\"padding-left: 40px;\"><strong>Conten\u00e7\u00e3o absoluta:<\/strong><\/p><p>N\u00e3o s\u00e3o admitidos novos registos, salvo autoriza\u00e7\u00e3o excecional da C\u00e2mara Municipal de Lisboa quando digam respeito a opera\u00e7\u00f5es de reabilita\u00e7\u00e3o de edif\u00edcios em ru\u00ednas ou reabilita\u00e7\u00e3o integral de edif\u00edcios totalmente devolutos h\u00e1 mais de tr\u00eas anos e quando sejam considerados de especial interesse para a cidade, por darem origem a edif\u00edcios de uso multifuncional, em que o alojamento local esteja integrado em projeto de \u00e2mbito social ou cultural de desenvolvimento local ou integre oferta de habita\u00e7\u00e3o para arrendamento a pre\u00e7os acess\u00edveis atribu\u00eddas no \u00e2mbito do Regulamento Municipal do Direito \u00e0 Habita\u00e7\u00e3o.<\/p><p style=\"padding-left: 40px;\"><strong>Conten\u00e7\u00e3o relativa:<\/strong><\/p><p>Novos registos dependem igualmente de autoriza\u00e7\u00e3o excecional, bastando verificar-se uma das condi\u00e7\u00f5es acima.<br \/>Admite-se ainda registo na modalidade \u201cquarto\u201d em im\u00f3veis T2 ou superiores, se forem resid\u00eancia permanente do titular (com domic\u00edlio fiscal h\u00e1 mais de tr\u00eas anos), com os seguintes limites:<\/p><ul><li>T2: 1 unidade de AL;<\/li><li>Superior a T2: at\u00e9 2 unidades de AL.<\/li><\/ul><p style=\"padding-left: 40px;\"><strong>Prazos:<\/strong><\/p><p>A autoriza\u00e7\u00e3o excecional de novos estabelecimentos de alojamento local em \u00e1reas de conten\u00e7\u00e3o \u00e9 conferida por um prazo de cinco anos, n\u00e3o renov\u00e1vel enquanto se mantiver a classifica\u00e7\u00e3o de \u00e1rea de conten\u00e7\u00e3o.<\/p><p>A autoriza\u00e7\u00e3o excecional de novos estabelecimentos de alojamento local em \u00e1reas de conten\u00e7\u00e3o relativa na modalidade \u201cquarto\u201d \u00e9 conferida pelo prazo de um ano, renov\u00e1vel por per\u00edodos sucessivos, desde que se verifique a manuten\u00e7\u00e3o do cumprimento dos requisitos respetivos.<\/p><p><strong>3. Restri\u00e7\u00f5es \u00e0 Transmissibilidade<\/strong><\/p><p>Nas zonas de conten\u00e7\u00e3o, a transmiss\u00e3o da titularidade do registo (seja por venda do im\u00f3vel ou cess\u00e3o da explora\u00e7\u00e3o) nas modalidades de &#8220;moradia&#8221; ou &#8220;apartamento&#8221; implica a caducidade do t\u00edtulo. O novo adquirente n\u00e3o &#8220;herda&#8221; o direito de explora\u00e7\u00e3o, tendo de submeter um novo pedido que ser\u00e1 avaliado \u00e0 luz dos r\u00e1cios de conten\u00e7\u00e3o do momento \u2013 o que, na pr\u00e1tica, pode significar a impossibilidade de manter a atividade de AL ap\u00f3s a venda.<\/p><p><strong>4. Suspens\u00e3o da explora\u00e7\u00e3o para arrendamento habitacional<\/strong><\/p><p>O altera\u00e7\u00e3o introduz ao RMAL uma flexibilidade: a possibilidade de suspender a atividade de AL por um per\u00edodo de at\u00e9 5 anos para converter o im\u00f3vel em arrendamento urbano.<br \/>Mas aten\u00e7\u00e3o: a reativa\u00e7\u00e3o do AL finda a suspens\u00e3o est\u00e1 condicionada \u00e0 exist\u00eancia de &#8220;vagas&#8221; nos r\u00e1cios de conten\u00e7\u00e3o da zona \u00e0 data do pedido de retoma. Se a zona estiver em conten\u00e7\u00e3o absoluta no futuro, o propriet\u00e1rio poder\u00e1 entrar numa lista de espera.<\/p><p><strong>5. Refor\u00e7o do Poder dos Condom\u00ednios e Fiscaliza\u00e7\u00e3o<\/strong><\/p><p>A conviv\u00eancia entre turistas e residentes ganha novos contornos legais. O RMAL estabelece que o Munic\u00edpio deve decidir sobre pedidos de cancelamento de registos apresentados por condom\u00ednios (devido a perturba\u00e7\u00f5es reiteradas) num prazo m\u00e1ximo de 90 dias.
