2025 entrou em vigor o Regulamento n.\u00ba 38\/2025, de 9 de janeiro, aprovado pela ANACOM, aprovando regras mais claras no que respeita \u00e0 portabilidade de n\u00fameros de telefone.<\/p><p>As novas regras refor\u00e7am a prote\u00e7\u00e3o dos consumidores e clarificam as responsabilidades e os prazos associados \u00e0 portabilidade, isto \u00e9, ao procedimento que permite ao utilizador mudar de operador mantendo o mesmo n\u00famero. Representam um ajustamento necess\u00e1rio para assegurar a conformidade com os aspetos introduzidos pela Lei das Comunica\u00e7\u00f5es Eletr\u00f3nicas, a Lei n.\u00ba 16\/2022, de 16 de agosto.<\/p><p>Dentre as principais mudan\u00e7as previstas, destacamos:<\/p><p style=\"padding-left: 40px;\"><strong>1. Prazos para conclus\u00e3o da portabilidade<\/strong><\/p><p>A empresa recetora deve concluir a portabilidade e ativar o n\u00famero na data acordada com o consumidor, no prazo mais curto poss\u00edvel e at\u00e9 um dia \u00fatil ap\u00f3s essa data. Quando seja necess\u00e1ria interven\u00e7\u00e3o t\u00e9cnica na rede, a portabilidade deve ser conclu\u00edda at\u00e9 um dia \u00fatil ap\u00f3s essa interven\u00e7\u00e3o. Caso a interven\u00e7\u00e3o termine depois das 17h, considera-se conclu\u00edda no dia \u00fatil seguinte.<\/p><p style=\"padding-left: 40px;\"><strong>2. Portabilidade sem encargos<\/strong><\/p><p>Nos termos do art. 5.\u00ba, n.\u00ba 9 do Regulamento aprovado, os operadores n\u00e3o podem cobrar encargos diretos ao consumidor pela portabilidade do n\u00famero.<\/p><p style=\"padding-left: 40px;\"><strong>3. Reembolso do saldo em servi\u00e7os pr\u00e9-pagos<\/strong><\/p><p>No caso de portabilidade de um n\u00famero associado a um servi\u00e7o pr\u00e9-pago, o operador de origem deve reembolsar o saldo existente mediante pedido do consumidor. O reembolso deve ser efetuado no prazo m\u00e1ximo de 10 dias \u00fateis. Pode existir um encargo proporcional aos custos suportados pela empresa, at\u00e9 ao limite de 1 \u20ac por opera\u00e7\u00e3o, desde que tal esteja previsto no contrato.<\/p><p style=\"padding-left: 40px;\"><strong>4. Compensa\u00e7\u00f5es por falhas na portabilidade<\/strong><\/p><p>O regulamento atualiza os valores de compensa\u00e7\u00e3o devidos ao consumidor:<\/p><p>&#8211; Atraso na portabilidade: 3 \u20ac por n\u00famero e por cada dia completo de atraso.<br \/>&#8211; Interrup\u00e7\u00e3o do servi\u00e7o na sequ\u00eancia de um pedido de portabilidade: 23 \u20ac por n\u00famero e por cada dia de interrup\u00e7\u00e3o, at\u00e9 5750 \u20ac por pedido de portabilidade.<br \/>&#8211; Falta a uma interven\u00e7\u00e3o t\u00e9cnica agendada por motivo n\u00e3o imput\u00e1vel ao consumidor: 10 \u20ac por nova marca\u00e7\u00e3o.<\/p><p style=\"padding-left: 40px;\"><strong>5. Valida\u00e7\u00e3o do titular atrav\u00e9s do C\u00f3digo de Valida\u00e7\u00e3o da Portabilidade (CVP)<\/strong><\/p><p>O operador recetor deve validar a identidade do titular do n\u00famero atrav\u00e9s do CVP. O Regulamento define o formato do c\u00f3digo e os meios para a sua disponibiliza\u00e7\u00e3o: fatura mensal nos servi\u00e7os p\u00f3s-pagos, SMS enviada em at\u00e9 24 horas ap\u00f3s a ativa\u00e7\u00e3o nos servi\u00e7os pr\u00e9-pagos ou disponibiliza\u00e7\u00e3o na \u00e1rea de cliente.<\/p><p>Salienta-se, tamb\u00e9m, que o consumidor deve tratar apenas com o novo operador, que \u00e9 respons\u00e1vel por todo o processo. A data da portabilidade deve ser acordada entre o consumidor e a nova empresa. Durante a janela de portabilidade, com dura\u00e7\u00e3o at\u00e9 tr\u00eas horas, pode ocorrer interrup\u00e7\u00e3o do servi\u00e7o. O consumidor deve ser informado dessa janela com pelo menos 12 horas de anteced\u00eancia.
