publicadas altera\u00e7\u00f5es significativas ao Regime Jur\u00eddico dos Instrumentos de Gest\u00e3o Territorial (RJIGT), introduzidas pelo Decretos-Lei n.\u00ba 117\/2024, de 30 de dezembro. Estas mudan\u00e7as visam garantir uma oferta de habita\u00e7\u00e3o digna e acess\u00edvel em Portugal, promovendo maior flexibilidade no uso do solo e incentivando a constru\u00e7\u00e3o de habita\u00e7\u00e3o p\u00fablica e acess\u00edvel. Abaixo destacamos os principais pontos destas altera\u00e7\u00f5es.<\/p><p><strong>Flexibiliza\u00e7\u00e3o na Reclassifica\u00e7\u00e3o de Solos<\/strong><\/p><p>Com o objetivo de aumentar o n\u00famero de terrenos destinados \u00e0 habita\u00e7\u00e3o, foi introduzida a possibilidade de reclassifica\u00e7\u00e3o de solos r\u00fasticos em urbanos, mediante procedimento simplificado ou altera\u00e7\u00e3o do plano diretor municipal. Para que esta reclassifica\u00e7\u00e3o seja permitida, \u00e9 necess\u00e1rio cumprir as seguintes condi\u00e7\u00f5es:<\/p><ul><li>Consolida\u00e7\u00e3o urbana: As novas \u00e1reas devem ser coerentes com a \u00e1rea urbana existente.<\/li><li>Destina\u00e7\u00e3o habitacional: Pelo menos 70% da \u00e1rea total de constru\u00e7\u00e3o acima do solo deve ser destinada a habita\u00e7\u00e3o p\u00fablica ou de valor moderado.<\/li><li>Infraestruturas adequadas: Devem existir ou ser garantidas infraestruturas, equipamentos coletivos e espa\u00e7os verdes necess\u00e1rios.<\/li><li>Compatibilidade com estrat\u00e9gias locais: A reclassifica\u00e7\u00e3o deve estar alinhada com estrat\u00e9gias locais ou cartas municipais de habita\u00e7\u00e3o.<\/li><\/ul><p><strong>Habita\u00e7\u00e3o de Valor Moderado<\/strong><\/p><p>Foi introduzido o conceito de habita\u00e7\u00e3o de valor moderado, definido como habita\u00e7\u00e3o cujo pre\u00e7o por metro quadrado (m\u00b2) n\u00e3o exceda a mediana nacional ou, no m\u00e1ximo, 125% do valor da mediana concelhia, at\u00e9 ao limite de 225% da mediana nacional. Estes valores ser\u00e3o apurados com base nas estat\u00edsticas mais recentes do Instituto Nacional de Estat\u00edstica (INE).<\/p><p>Os im\u00f3veis classificados como habita\u00e7\u00e3o de valor moderado estar\u00e3o sujeitos a:<\/p><ul><li>Registo predial obrigat\u00f3rio, indicando a afeta\u00e7\u00e3o do solo e os limites de pre\u00e7o de venda.<\/li><li>Anula\u00e7\u00e3o das transa\u00e7\u00f5es que excedam os valores m\u00e1ximos permitidos.<\/li><li>Direito de prefer\u00eancia dos munic\u00edpios ap\u00f3s a primeira transmiss\u00e3o de pr\u00e9dios ou fra\u00e7\u00f5es aut\u00f3nomas.<\/li><\/ul><p><strong>Novos Prazos e Condicionantes<\/strong><\/p><p>As opera\u00e7\u00f5es urban\u00edsticas devem ser realizadas num prazo m\u00e1ximo de cinco anos, prorrog\u00e1vel uma \u00fanica vez por, pelo menos, metade do prazo inicial, desde que iniciadas as obras.
