conhecimento p\u00fablico, o Presidente da Rep\u00fablica vetou o conjunto de diplomas do \u201c<strong>Programa Mais Habita\u00e7\u00e3o<\/strong>\u201d.<\/p><p>Mas o Partido Socialista j\u00e1 fez saber que n\u00e3o vai promover altera\u00e7\u00f5es ao texto dos diplomas e que far\u00e1 aprovar os mesmos, agora em setembro. Com o recome\u00e7o dos trabalhos parlamentares, tudo parecia indicar que o diploma ia entrar em vigor em meados de setembro. N\u00e3o obstante, como se a pol\u00e9mica instalada n\u00e3o fosse bastante, o Presidente da Rep\u00fablica veio relembrar que o decreto regulamentar ainda v\u00e3o ser algo da sua an\u00e1lise, dado que a lei n\u00e3o se pode aplicar em muitas das suas vertentes sem o referido decreto regulamentar.<\/p><p><strong>Revisitemos os principais pontos do novo regime:<\/strong><\/p><ul><li><strong>Limites \u00e0s novas rendas<\/strong><\/li><\/ul><p>Por um per\u00edodo transit\u00f3rio de sete anos, os novos contratos de arrendamento de im\u00f3veis que tenham estado no mercado nos \u00faltimos 5 anos ficam sujeitos a um teto m\u00e1ximo de 2%. O referido limite aplica-se quando a nova proposta do senhorio exceda os montantes m\u00e1ximos por tipologia previstos no programa de arrendamento acess\u00edvel. Em Lisboa, o limite previsto para um T1 \u00e9 de 900 euros, para um T2 de 1.150 euros e para um T3 de 1.375 euros.<\/p><ul><li><strong>Rendas antigas congeladas<\/strong><\/li><\/ul><p>As rendas anteriores a 1990 v\u00e3o ficar congeladas para sempre e n\u00e3o transitam para o Novo Regime de Arrendamento Urbano. Os senhorios ficar\u00e3o isentos do pagamento de IMI e IRS e haver\u00e1 uma compensa\u00e7\u00e3o por parte do Estado que ainda n\u00e3o foi definida.<\/p><ul><li><strong>Arrendamento for\u00e7ado<\/strong><\/li><\/ul><p>O arrendamento for\u00e7ado ser\u00e1 aplicado de forma \u201cexcecional\u201d e \u201csupletiva\u201d por parte das autarquias que assim o entendam relativamente aos im\u00f3veis que sejam considerados devolutos h\u00e1 mais de 2 anos e com IMI agravado. O propriet\u00e1rio conta com 90 dias para responder \u00e0 intima\u00e7\u00e3o do munic\u00edpio para fazer obras ou dar uso \u00e0 fra\u00e7\u00e3o.<\/p><ul><li><strong>Alojamento Local<\/strong><\/li><\/ul><p>O diploma prev\u00ea que a par da suspens\u00e3o de novos registos nas zonas do litoral, a atividade nas zonas de conten\u00e7\u00e3o fica sujeita a uma contribui\u00e7\u00e3o extraordin\u00e1ria de 15%. Contribui\u00e7\u00e3o que recai apenas sobre apartamentos e exclui moradias e pr\u00e9dios inteiros dedicados a AL, independentemente de terem atividade ou n\u00e3o.<\/p><p>Outra novidade passa por exigir aos novos ALs em pr\u00e9dio de habita\u00e7\u00e3o a aprova\u00e7\u00e3o pr\u00e9via dos mesmos pelo condom\u00ednio, j\u00e1 n\u00e3o sendo suficiente para o efeito a licen\u00e7a camar\u00e1ria.<\/p><ul><li><strong>Incentivos ao arrendamento<\/strong><\/li><\/ul><p>A n\u00edvel de incentivos fiscais para o arrendamento, baixa-se de 28% para 25% a taxa que se aplica aos rendimentos prediais, e preveem-se redu\u00e7\u00f5es proporcionais \u00e0 dura\u00e7\u00e3o dos contratos. Por ex. os contratos entre 5 e 10 anos ser\u00e3o tributados \u00e0 taxa de 23% e entre 10 a 20 anos a 14%. Os senhorios v\u00e3o tamb\u00e9m passar a poder deduzir os seguros de renda em sede de IRS.<\/p><ul><li><strong>Arrendar ao Estado<\/strong><\/li><\/ul><p>O diploma tamb\u00e9m prev\u00ea que o Estado e autarquias arrendem im\u00f3veis a privados para depois os subarrendarem aos agregados cuja taxa de esfor\u00e7o seja superior a 35% e cujos rendimentos n\u00e3o ultrapassem o 6\u00ba escal\u00e3o de IRS, ou seja, at\u00e9 38.632 euros, em 2023. O programa ser\u00e1 operacionalizado pelo IHRU e pelo Estado e contar\u00e1, ao que tudo indica, com a participa\u00e7\u00e3o de mediadoras imobili\u00e1rias. O governo prev\u00ea uma despesa de \u20ac2,8 milh\u00f5es at\u00e9 2030.<\/p><ul><li><strong>Refor\u00e7o do Porta 65<\/strong><\/li><\/ul><p>O programa <strong>Mais Habita\u00e7\u00e3o<\/strong> vai refor\u00e7ar o Programa Porta 65 de subs\u00eddio de renda aos jovens at\u00e9 35 anos, que passa a ter candidatura cont\u00ednua a longo do ano em vez das atuais 3 candidaturas anuais.
