teletrabalho a presta\u00e7\u00e3o laboral realizada com a subordina\u00e7\u00e3o jur\u00eddica, habitualmente fora da empresa, recorrendo a tecnologias de informa\u00e7\u00e3o e de comunica\u00e7\u00e3o.<\/p><p><strong>Princ\u00edpio de Igualdade<\/strong><\/p><p>O trabalhador em regime de teletrabalho tem os mesmos direitos e deveres dos demais trabalhadores, nomeadamente no que se refere ao acesso ao trabalho, \u00e0 forma\u00e7\u00e3o e evolu\u00e7\u00e3o na carreira profissional, aos limites de per\u00edodo normal de trabalho e outras condi\u00e7\u00f5es de trabalho, \u00e0 seguran\u00e7a, sa\u00fade e higiene no trabalho e a repara\u00e7\u00e3o de danos emergentes de acidente de trabalho ou doen\u00e7as profissionais.<\/p><p>Este regime n\u00e3o pode de forma alguma implicar o isolamento nem pessoal nem profissional do teletrabalhador.<\/p><p>O empregador est\u00e1 vinculado ao dever de promover contatos regulares entre o teletrabalhador e os demais trabalhadores da empresa com o objetivo de evitar o isolamento profissional dos teletrabalhadores.<\/p><p><strong>Forma do Contrato e os seus elementos<\/strong><\/p><p>O contrato de teletrabalho deve ser reduzido a escrito e deve conter os seguintes elementos: a identifica\u00e7\u00e3o das partes, sede da empresa, domic\u00edlio do trabalhador, sede do trabalho, indica\u00e7\u00e3o do cargo ou da atividade a prestar, com men\u00e7\u00e3o expressa de recurso ao teletrabalho, indica\u00e7\u00e3o da retribui\u00e7\u00e3o, per\u00edodo normal de trabalho, assinatura das partes.<\/p><p><strong>Plano de Teletrabalho<\/strong><\/p><p>O empregador pode estabelecer um plano peri\u00f3dico de teletrabalho de acordo com os objetivos da empresa e acordar com o teletrabalhador a concretiza\u00e7\u00e3o desse plano, e o tempo do contrato de trabalho pode ser ajustado ao tempo de execu\u00e7\u00e3o do plano de teletrabalho estabelecido pelo empregador, sem preju\u00edzo da antiguidade do trabalhador na empresa.<\/p><p><strong>Subordina\u00e7\u00e3o Jur\u00eddica<\/strong><\/p><p>A atividade de teletrabalho \u00e9 exercida pelo trabalhador mediante ordens e instru\u00e7\u00f5es dadas diretamente pelo empregador ou pessoa mandatada por este, e \u00e9 compat\u00edvel com o regime de subordina\u00e7\u00e3o jur\u00eddica a presta\u00e7\u00e3o da atividade desenvolvida pelo trabalhador, orientada para objetivos e resultados.<\/p><p><strong>Isen\u00e7\u00e3o de hor\u00e1rio<\/strong><\/p><p>Pode o trabalhador em regime de teletrabalho estar sujeito a isen\u00e7\u00e3o de hor\u00e1rio, mediante acordo entre o teletrabalhador e o empregador.<\/p><p><strong>Teletrabalho no Domic\u00edlio <\/strong><\/p><p>As partes no contrato de teletrabalho podem acordar que a atividade desenvolvida pelo teletrabalhador ocorra no domic\u00edlio deste ou em local escolhido por este, competindo ao empregador contribuir para a cria\u00e7\u00e3o das condi\u00e7\u00f5es, nomeadamente ergon\u00f3micas que garantam a presta\u00e7\u00e3o da atividade em condi\u00e7\u00f5es de seguran\u00e7a para o teletrabalhador.<\/p><p>A presta\u00e7\u00e3o da atividade de teletrabalho no domic\u00edlio n\u00e3o pode em caso algum afetar a vida privada e familiar do teletrabalhador e nem p\u00f4r em causa a seguran\u00e7a do lar.<\/p><p>\u00a0Por acordo entre o teletrabalhador e o empregador o teletrabalho no domic\u00edlio pode ser deslocado para outro local.<\/p><p><strong>Teletrabalhador Estrangeiro<\/strong><\/p><p>Considera-se teletrabalhador estrangeiro o individuo de nacionalidade estrangeira, residente em Cabo Verde, que exerce uma atividade laboral em regime de teletrabalho.<\/p><p>Relativamente ao teletrabalhador estrangeiro s\u00e3o aplic\u00e1veis o disposto no c\u00f3digo laboral relativo \u00e0 contrata\u00e7\u00e3o de estrangeiros e o estabelecido nas leis que regulam \u00e0 entrada, perman\u00eancia, sa\u00edda e
