pessoas \u00e9 uma realidade que se traduz numa das formas mais graves de viola\u00e7\u00e3o dos direitos humanos, trata-se de um fen\u00f3meno complexo que ocorre, maioritariamente, na clandestinidade e, por vezes, estende-se pelas jurisdi\u00e7\u00f5es de v\u00e1rios Estados o que torna dif\u00edcil a sua identifica\u00e7\u00e3o e a aplica\u00e7\u00e3o da lei.<\/p><p>Apesar de ser abrangente, atinge grupos sociais espec\u00edficos que se apresenta com maior vulnerabilidade e por isso mesmo se tornam v\u00edtimas, como \u00e9 o caso de crian\u00e7as e mulheres.<\/p><p>Cabo Verde n\u00e3o est\u00e1 imune ao tr\u00e1fico humano, devido \u00e0 sua localiza\u00e7\u00e3o, situado a 570km do largo da costa ocidental da \u00c1frica e ocupando uma posi\u00e7\u00e3o geostrat\u00e9gica num triangulo entre os continentes Africano, Americano e Europeu, facilmente atrai o interesse de grupos do crime organizado ativos nesses continentes que veem Cabo Verde como um ponto de tr\u00e2nsito conveniente.<\/p><p>Em Cabo Verde existem situa\u00e7\u00f5es que podem configurar como tr\u00e1fico, nomeadamente o turismo sexual e a prostitui\u00e7\u00e3o, sobretudo nas ilhas tur\u00edsticas Sal, Boavista e S\u00e3o Vicente, para al\u00e9m dos potenciais casos de explora\u00e7\u00e3o sexual, foram identificados casos de poss\u00edvel tr\u00e1fico de drogas for\u00e7ado, na maioria dos casos, as mulas intercetadas\/presas t\u00eam sido jovens mulheres Cabo-Verdianas e Brasileiras.<\/p><p>Alguns casos de desaparecimento de crian\u00e7as tamb\u00e9m colocou as autoridades em alerta e mais vigilante, no entanto \u00e9 dif\u00edcil determinar se esses casos foram casos de tr\u00e1fico de pessoas ou de outros crimes como ado\u00e7\u00e3o ilegal, lenoc\u00ednio, etc, uma vez que antes de 2015, havia uma aus\u00eancia de enquadramento legal, pelo que muitos casos n\u00e3o eram identificados.<\/p><p>Para uma melhor identifica\u00e7\u00e3o dos casos de tr\u00e1fico de pessoas recomenda-se uma maior sensibiliza\u00e7\u00e3o desse fen\u00f3meno, tamb\u00e9m para que se possa fazer a preven\u00e7\u00e3o, prote\u00e7\u00e3o \u00e0s v\u00edtimas e repress\u00e3o ao crime.<\/p><p>O C\u00f3digo Penal, aprovado pelo Decreto-legislativo n.\u00ba 4\/2003 de 18 de novembro, n\u00e3o tipificou como crimes o tr\u00e1fico de pessoas, pelo que at\u00e9 a sua altera\u00e7\u00e3o em 2015 esta conduta n\u00e3o era prevista nem punida no nosso ordenamento.<\/p><p>No entanto a incrimina\u00e7\u00e3o era sugerida por conven\u00e7\u00f5es internacionais como a Conven\u00e7\u00e3o de M\u00e9rida (artigos 15.\u00ba, 16.\u00ba, 17.\u00ba e 19.\u00ba) e a Conven\u00e7\u00e3o de Palermo (artigos 8.\u00ba e 10.\u00ba) e seus Protocolos (Protocolo Adicional Relativo \u00e0 Preven\u00e7\u00e3o, Repress\u00e3o e Puni\u00e7\u00e3o do Tr\u00e1fico de Pessoas, em especial Mulheres e Crian\u00e7as e o Protocolo Adicional contra o Tr\u00e1fico Il\u00edcito de Migrantes).<\/p><p>Assim com a altera\u00e7\u00e3o do c\u00f3digo penal em 2015, tipificou-se o <u>TR\u00c1FICO DE PESSOAS<\/u> no seu artigo 271.\u00ba &#8211; A \u201c<strong><em>Quem oferecer, entregar, aliciar, aceitar, transportar, alojar ou acolher pessoa para fins de explora\u00e7\u00e3o sexual, explora\u00e7\u00e3o do trabalho ou extra\u00e7\u00e3o de \u00f3rg\u00e3os\u2026 \u00e9 punido com pena de 4 a 10 anos de pris\u00e3o<\/em><\/strong>\u201d.<\/p><p>Deste conceito pode-se dizer que o Tr\u00e1fico de Pessoas se dividi em 3 categorias\/tipos:<\/p><ul><li>Tr\u00e1fico para explora\u00e7\u00e3o sexual.<\/li><li>Tr\u00e1fico para explora\u00e7\u00e3o laboral.<\/li><li>Tr\u00e1fico para extra\u00e7\u00e3o de \u00f3rg\u00e3os.<\/li><\/ul><p>Atualmente o C\u00f3digo Penal ligado a esta mat\u00e9ria, prev\u00ea crimes como:<\/p><ul><li>Tr\u00e1fico de \u00f3rg\u00e3os humanos (art. 131.\u00ba -B) com pena de 4 a 10 anos de pris\u00e3o;<\/li><li>Lenoc\u00ednio (art. 148) com pena de 6 a 10 anos de pris\u00e3o;<\/li><li>Aliciamento de menor para pr\u00e1tica de acto sexual ou prostitui\u00e7\u00e3o no estrangeiro (art. 149.\u00ba) com pena de 6 a 12 anos de pris\u00e3o.<\/li><\/ul><p>A Lei n.\u00ba 66\/VIII\/2014 de 17 Julho, que prev\u00ea Regime Jur\u00eddico de Entrada, Sa\u00edda e Expuls\u00e3o, de Estrangeiros do Territ\u00f3rio Nacional, prev\u00ea autoriza\u00e7\u00e3o de resid\u00eancia em situa\u00e7\u00f5es especiais, a pessoas que tenham beneficiado de autoriza\u00e7\u00e3o de resid\u00eancia concedida a v\u00edtimas de tr\u00e1fico de pessoas.<\/p><p>Cabo Verde encontra-se alinhado \u00e0s Pol\u00edticas Internacionais, tendo aderido \u00e0 Conven\u00e7\u00e3o de M\u00e9rida, ao Protocolo Relativo \u00e0 Preven\u00e7\u00e3o, Repress\u00e3o e Puni\u00e7\u00e3o do Tr\u00e1fico de Pessoas, em especial Mulheres e Crian\u00e7as, que complementa a Conven\u00e7\u00e3o das Na\u00e7\u00f5es Unidas contra o Crime Organizado Transnacional, vulgarmente conhecida como Conven\u00e7\u00e3o de Palermo e, desde 2017, \u00e0 Campanha Cora\u00e7\u00e3o Azul realizado em parceria com o ONUDC (Escrit\u00f3rio das Na\u00e7\u00f5es Unidas sobre Drogas e Crime).<\/p><p>Tivemos tamb\u00e9m entre os anos de 2018 a 2021 o primeiro Plano Nacional de Luta Contra o Tr\u00e1fico de Pessoas.<\/p><p>Na luta contra este flagelo, o Governo de Cabo Verde atrav\u00e9s do Minist\u00e9rio da Justi\u00e7a tem contado tamb\u00e9m com entidades ligadas \u00e0 luta contra o Tr\u00e1fico de Pessoas, nomeadamente a ONUDC e a
