32\/X\/2023 de 4 de agosto de 2023 procede \u00e0 terceira altera\u00e7\u00e3o do C\u00f3digo Laboral Cabo-verdiano (aprovado pelo Decreto-Legislativo n.\u00ba 5\/2007, de 16 de outubro, alterado pelo Decreto- Legislativo n.\u00ba 5\/2010, de 16 de junho e pelo Decreto-Legislativo n.\u00ba 1\/2016, de 3 de fevereiro).<\/p><p>S\u00e3o alterados os artigos 271.\u00ba e 274.\u00ba do C\u00f3digo Laboral Cabo-verdiano.<\/p><p>A r\u00e1cio desta altera\u00e7\u00e3o d\u00e1-se pela recomenda\u00e7\u00e3o da Organiza\u00e7\u00e3o Mundial da Sa\u00fade, no sentido da amamenta\u00e7\u00e3o exclusiva, justificando assim o alargamento da licen\u00e7a de maternidade e ainda pelo facto de o C\u00f3digo Laboral Cabo-verdiano n\u00e3o prever uma efetiva licen\u00e7a de paternidade.<\/p><p>Ademais, o novo regime jur\u00eddico do Emprego P\u00fablico, aprovado pela Lei n.\u00ba20\/X\/2023, de 24 de mar\u00e7o, procedeu ao alargamento do per\u00edodo de licen\u00e7a de maternidade e consagrou a licen\u00e7a de paternidade.<\/p><p>Neste sentido, com vista a harmoniza\u00e7\u00e3o dos regimes do setor p\u00fablico e privado foi igualmente alargado o per\u00edodo de licen\u00e7a de maternidade e consagrou a licen\u00e7a de paternidade.<\/p><p>Deste modo, para a promo\u00e7\u00e3o da igualdade de g\u00e9nero, o artigo 271.\u00ba do C\u00f3digo Laboral Cabo-verdiano passa a estabelecer uma licen\u00e7a parental.<\/p><p>Passando o pai a ter direito a dez dias \u00fateis obrigat\u00f3rios de licen\u00e7a, gozados imediatamente a seguir ao nascimento do filho.\u00a0<\/p><p>Por outro lado, a licen\u00e7a de maternidade passa a ser de noventa dias.\u00a0<\/p><p>E ainda foi inserido no artigo 271.\u00ba do C\u00f3digo Laboral Cabo-verdiano o n\u00famero 5 estabelecendo que \u201cA morte ou a incapacidade f\u00edsica ou ps\u00edquica da m\u00e3e n\u00e3o trabalhadora durante o per\u00edodo de cento e vinte dias imediatamente a seguir ao parto confere ao pai os direitos previstos nos n\u00fameros 3 e 4\u201d.<\/p><p>Foi alterado tamb\u00e9m o artigo 274.\u00ba do C\u00f3digo Laboral Cabo-verdiano passando o mesmo a ter a seguinte reda\u00e7\u00e3o \u201cPara efeitos de amamenta\u00e7\u00e3o, a trabalhadora tem direito, durante os primeiros seis meses a seguir ao parto, a duas horas de dispensa por dia, podendo ser divididas em dois per\u00edodos\u201d.<\/p><p>Por fim \u00e9 revogada a al\u00ednea j) do n\u00famero 2 do artigo 186.\u00ba do C\u00f3digo Laboral Cabo-verdiano, que previa at\u00e9 duas faltas consecutivas dadas pelo pai por ocasi\u00e3o do nascimento do filho.<\/p><p>A presente altera\u00e7\u00e3o entrou em vigor no dia 5 de agosto de 2023.<\/p><p>Com a presente altera\u00e7\u00e3o se alcan\u00e7a a t\u00e3o proclamada igualdade de g\u00e9nero.<\/p><p>Com a cria\u00e7\u00e3o da licen\u00e7a parental vem dar aos pais a oportunidade de estarem com as suas crian\u00e7as, logo \u00e0 nascen\u00e7a.<\/p><p>A maternidade e a paternidade s\u00e3o igualmente importantes.
