econ\u00f3mico est\u00e1 a interferir com o mercado do arrendamento. Se at\u00e9 aqui, por regra, as partes n\u00e3o perdiam muito tempo na negocia\u00e7\u00e3o do regime a aplicar ao aumento de rendas, remetendo a quest\u00e3o para a aplica\u00e7\u00e3o dos coeficientes de atualiza\u00e7\u00e3o vigentes, por certo que esta pr\u00e1tica estar\u00e1 em vias de ser revista.<\/p><p>Com efeito, o senhorio e o inquilino podem estipular, por escrito, a possibilidade de as rendas contratualizadas serem atualizadas, estabelecendo, por acordo, o regime de tal atualiza\u00e7\u00e3o.<\/p><p>Na falta de estipula\u00e7\u00e3o, o que at\u00e9 aqui sempre foi a regra, ao aumento de rendas aplica-se o regime supletivo previsto no artigo 1077.\u00ba do C\u00f3digo Civil. De acordo com este regime, a renda pode ser atualizada anualmente, conforme os coeficientes de atualiza\u00e7\u00e3o vigentes.<\/p><p>A primeira atualiza\u00e7\u00e3o da renda pode ser exigida um ano ap\u00f3s o in\u00edcio da vig\u00eancia do contrato e as seguintes, sucessivamente, um ano ap\u00f3s a atualiza\u00e7\u00e3o anterior. Para o efeito, o senhorio ter\u00e1 de comunicar, por escrito (por carta registada com aviso de rece\u00e7\u00e3o ou entregue em m\u00e3o, com protocolo de rece\u00e7\u00e3o) e com a anteced\u00eancia m\u00ednima de 30 dias antes do pagamento da nova renda, o coeficiente de atualiza\u00e7\u00e3o e nova renda dele resultante.<\/p><p>O coeficiente de atualiza\u00e7\u00e3o das rendas \u00e9 apurado pelo Instituto Nacional de Estat\u00edstica (INE) anualmente e publicado no Di\u00e1rio da Rep\u00fablica, at\u00e9 30 de outubro de cada ano, para poder ser aplicado desde o in\u00edcio do ano seguinte.<\/p><p>Para o ano de 2023, a Lei 19\/2022, de 21 de outubro, para combater o ciclo inflacionista e a perda do poder de compra, imp\u00f4s a atualiza\u00e7\u00e3o das rendas no coeficiente 1,02 (2%), determinando a n\u00e3o aplica\u00e7\u00e3o do coeficiente de atualiza\u00e7\u00e3o das rendas previsto no artigo 24.\u00ba da Lei 6\/2006, de 27 de fevereiro, que aprovou o NRAU, segundo o qual o coeficiente de atualiza\u00e7\u00e3o anual das rendas \u00e9 o resultante da totalidade da varia\u00e7\u00e3o do \u00edndice de pre\u00e7os no consumidor, sem habita\u00e7\u00e3o, correspondente aos \u00faltimos 12 meses e, de acordo com valores dispon\u00edveis \u00e0 data de 31 de agosto, apontaria para um aumento de rendas na ordem dos 5,43%.<\/p><p>Desta forma, se as partes n\u00e3o tiverem estabelecido outro regime, o coeficiente de atualiza\u00e7\u00e3o das rendas dos diversos tipos de arrendamento urbano (habita\u00e7\u00e3o, em regime de renda livre, condicionada ou apoiada, com\u00e9rcio, ind\u00fastria, exerc\u00edcio de profiss\u00e3o liberal e outros fins n\u00e3o habitacionais) e rural, para vigorar no ano civil de 2023, ser\u00e1 de 2%. Os senhorios que n\u00e3o tenham atualizado rendas em 2022, poder\u00e3o adicionar ao coeficiente de 2% previsto para 2023, o coeficiente de 0,43% referente ao ano 2022.<\/p><p>A limita\u00e7\u00e3o ao aumento das rendas imposta pelo Governo aplica-se a todos os inquilinos com contratos celebrados at\u00e9 dezembro de 2022 e desde que as partes n\u00e3o tenham convencionado outro regime.<\/p><p>Deste modo, se \u00e9 propriet\u00e1rio e se pretender ter retorno efetivo no mercado do arrendamento ou mitigar a deprecia\u00e7\u00e3o de investimentos imobili\u00e1rios efetuados, sugerimos que ap\u00f3s dezembro de 2022, nos contratos que celebre, escolha e aplique o regime que pretende aplicar \u00e0 atualiza\u00e7\u00e3o das rendas, afastando a aplica\u00e7\u00e3o do regime supletivo do coeficiente atualizado ao \u00edndice de pre\u00e7os do INE, faculdade que a lei confere. Deste modo, evitar\u00e1 deixar a atualiza\u00e7\u00e3o de rendas \u00e0 merc\u00ea da conjuntura econ\u00f3mica e do risco do maior ou menor intervencionismo do poder pol\u00edtico no mercado do arrendamento.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fda516d elementor-hidden-desktop elementor-hidden-tablet elementor-hidden-mobile
